29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.  While performing stucco operations the employer did not initiate an adequate safety program that would ensure a safe and healthful working environment. In this case the employees were exposed to a fall hazard of eight (8) feet from the working surface to the ground below. Ladders were used on the scaffold and leaned against the building without stabilizing the scaffold.

29 CFR 1926.451(f)(15): Ladders were used on scaffolds to increase the working level height of employees: without satisfying the criteria of subparagraphs (i) - (iv) of this paragraph.  Near the northeast corner of the building being constructed - The employer did not ensure that ladders were not used on a scaffold to increase the working height without taking the required precautions to ensure the stability of the scaffold. Employees were exposed to a fall hazard of approximately eight (8) feet.
