29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  On or about 9/1/2017 at 2630 Old Winder Highway Braselton, GA. roofers were observed installing roof sheathing  plywood on the new construction Dunkin Donuts without any personal fall protection. Workers were exposed to 18-foot fall hazards to the lower level.

29 CFR 1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were  made without the manufacturer's written approval:  On or about 9/1/2017 at 2360 Old winder Highway Braselton, GA, an employee was observed performing plywood siding installation from a wooden box being lifted by the forks  of the RT JLG forklift exposing him to fall hazards of 8-feet to the lower level.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  On or about 9/1/2017 at 2360 Old winder Highway Braselton, GA, the employer failed to train or certify the operator of the JLG powered industrial truck that was observed in use with a worker performing plywood siding installation from a wooden box on the forks of the JLG lift exposing him to fall hazards of 8-feet to the lower level.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  On or about 9/1/2017 at 2630 Old Winder Highway Braselton, GA; a worker was observed exposed to a 5-foot fall hazard while taking a measurement from a closed 6-foot Werner step ladder that was used in a closed set-up, leaning against the wall.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:  On or about 9/1/2017 at 2630 Old Winder Highway Braselton, GA; workers accessing and egressing the roof were exposed to 18-foot fall hazards where the visibly damaged Werner metal extension ladder was not removed from service. The left vertical support was bent at the 4th rung from the top. Support damage could cause potential stability issues that could promote tip over. The 3rd rung from the top was dented which could cause slip hazards. Additionally, both feet were missing which could promote potential tipping and fall hazards in soft earth.
