29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New townhome construction on Lot #26, Roof Trusses: On or about 09/05/2017, and at times prior, the employer exposed employees to fall hazards of approximately 21-feet, 6-inches to the lower level, in that no fall protection system was provided to employees engaged in framing and sheathing activities. (b) New townhome construction on Lot #26, Rear roof deck: On or about 09/05/2017, and at times prior, the employer exposed employees to fall hazards of 21-feet, 6-inches on a 5/12 pitched roof to the lower ground level, in that a complete fall protection system was not provided or used while employees were engaged in plywood sheathing activities.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees: a) New townhome construction on Lot #26, Rear concrete pad: On or about 09/05/2017, and at times prior, the employer failed to inspect all electrical cords prior to the start of the work shift, in that a 50 ft. flexible cord used to power a Makita (Model 5007F) 7-1/4-inch Circular Saw had a torn outer casing with exposed inner circuits as this cord was not repaired or removed from service.
