The scaffold was inspected on the day it was erected and found to be missing a caster wheel lock. The scaffold was not repaired, replaced, nor removed from service until repaired. NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

The scaffold was inspected on the day it was erected but not on the three following days that it was used. The R.C. Torre Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(f)(3) , which was contained in OSHA inspection number 1045767, citation number 1, item number 7 and was affirmed as a final order on 5/4/2015, with respect to a workplace located at 95 Springhurst Rd. Bedford, NY 10506. NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
