29 CFR 1910.134(c)(2)(i): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"): Shop: on or about September 6, 2017, employees voluntarily using 3M masks type N95 during wood sanding were not provided with information pertaining to their design, limitations, and manufacturer's instruction in use, maintenance, cleaning and care, and other warnings. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: Shop: on or about September 6, 2017, employees were using lacquer thinner, denatured alcohol, and adhesives for product surface preparation, finishing, and cleaning work tasks that exposed their skin and eyes to contact with irritants. A written Hazardous Communication Program with workplace-specific warning labeling, safety data sheets, and training was not developed, implemented, and maintained onsite to ensure safe chemicals use and storage. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
