29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about September 6, 2017, located at 5170 Saint Andrews Drive in Westerville, Ohio, an employee was performing painting on a residential home from a steep-slope roof without any means of fall protection, thereby exposing the employee to a fall hazard of approximately 10 feet.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders shall be used at an angle such that the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).   a. On or about September 6, 2017, an extension ladder was used to gain access to the roof and another ladder to paint the gable end of a residential home at 5170 Saint Andrews Drive in Westerville, Ohio. The horizontal distance from the top of the ladder to the bottom was not one-quarter the working length of the ladder, thereby exposing the employee to a maximum fall hazard of approximately 10 feet.

On or about September 6, 2017, an extension ladder was leaned against a steep-pitched roof and used to climb to paint the gable end of a residential home at 5170 Saint Andrews Drive in Westerville, Ohio, thereby exposing the employee to a fall hazard of approximately 10 feet.
