29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a) Workplace, 1435 51st Street, North Bergen, NJ 07047    a) An employee fabricating granite and quartz countertops was exposed to continuous noise levels at 171.6 %  of the permissible  daily noise exposure (8 hour Time Weighted Average sound level of 90 dBA) which is 1.71 times the allowable exposure limit.  The action level (AL) is 85 dBA.  The equivalent sound level of the measured dose is 93.9 dBA.  Sampling was performed for 343 minutes on 09/05/2017, with the unsampled portion of time considered to represent zero for the exposure calculation.    b) An employee fabricating granite and quartz countertops was exposed to continuous noise at 85.2% of the permissible daily noise exposure (8 hour Time Weighted Average sound level of 90 dBA) which is 0.85 times the allowable exposure limit.  The action level (AL) is 85 dBA.  The equivalent sound level of the measured dose is 88.8 dBA.  Sampling was performed for 343 minutes on 09/05/2017, with the unsampled portion of time considered to represent zero for the exposure calculation.      Violation occurred on or about 09/05/2017

However, the employer failed to verify that the workplace hazard assessment had been conducted.  In addition, the employer failed to provide hearing protection for workers fabricating granite and quartz countertops exposed to continuous noise above the OSHA permissible exposure limit and action level.
