OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to the hazard of heat-related stress: a) On or about August 22, 2017, at jobsites located at 4515 S. Tamiami Trail and 5090 Saratoga Place in Sarasota, Florida, employees performing professional moving services were exposed to heat-related hazards where the heat index ranged from 97°F to 105°F.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident: a) On August 22, 2017, at a jobsite located at 5090 Saratoga Place in Sarasota, Florida, an employee carrying household goods was ascending the second of three flights of stairs when he collapsed onto the landing, was taken to a hospital and later succumbed from heat stroke. The employer did not report the work-related death of the employee.
