29 CFR 1910.132(f)(1): The employer shall provide training to each employee who is required by this section to use PPE. Each such employee shall be trained to know at least the following:     The employer did not provide training to each employee, who is required by this section to use personal protective equipment (PPE), on when PPE is necessary; what PPE is necessary; how to properly don, doff, adjust, and wear PPE; the limitations of the PPE; and the proper care, maintenance, useful life and disposal of the PPE.     (A) On or about June 28, 2017, the employer did not provide training to an employee who was required to wear personal protective equipment such as while operating a compact mini skid steer including but not limited to hearing protection.     (B) On July 19, 2017, the employer did not provide training to an employee who was required to wear personal protective equipment such as while operating a compact mini skid steer including but not limited to hearing protection.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    (A) On or about June 28, 2017, there were no frequent and regular inspections being performed by a competent person to ensure the jobsite, materials and equipment such as a compact mini skid steer were being maintained and utilized in a safe condition.     (B) On July 19, 2017, there were no frequent and regular inspections being performed by a competent person to ensure the jobsite, materials and equipment such as a compact mini skid steer were being maintained and utilized in a safe condition.

29 CFR 1926.20(b)(4): The employer shall permit only those employees qualified by training or experience to operate equipment and machinery.    (A) On or about June 28, 2017, an employee who had not been trained to operate a compact mini skid steer was allowed to operate such equipment to remove dirt, rocks and bushes.     (B) On July 19, 2017, an employee who had not been trained to operate a compact mini skid steer was allowed to operate such equipment to remove dirt, rocks and bushes.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.    On July 19, 2017, an employee was hospitalized for work related injuries sustained while offloading a compact mini skid steer from a utility trailer at a commercial establishment in Bethel, OH. The employer failed to report the in-patient hospitalization within 24 hours as the report was received via complaint on September 6, 2017.
