29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    On September 7, 2017, there were no frequent and regular inspections being performed by a competent person to ensure the jobsite, materials and equipment such as tubular welded frame scaffold platforms, commercial fall protection systems and/or devices were being maintained and utilized in a safe condition.

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) shall be installed so that the space between adjacent units and the space between the platform and the uprights is no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary (for example, to fit around uprights when side brackets are used to extend the width of the platform).    On September 7, 2017, two employees were observed working from a tubular welded frame scaffold that was not fully planked on all working levels.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.    Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.    On September 7, 2017, an employee was observed using the top of a scaffold frame as a working platform to increase the working height of a tubular welded frame scaffold while not utilizing a fall protection system. Potential fall heights were measured to be greater than 13 feet.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    On September 7, 2017, employees were observed working on a tubular welded frame scaffold that had not received training to recognize the hazards associated with the type of scaffold being used, and to understand the procedures to control or minimize those hazards. Potential fall heights for one employee were measured to be greater than 13 feet above the concrete surface below while not utilizing a fall protection system.
