29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: Construction Site: On or about September 5, 2017, two employees were observed working on a roof without utilizing the fall protection equipment they were wearing. Employees did not connect to a lifeline. This condition exposed the employees to a fall hazard of more than 6-ft. to the ground below. Federico Urena was previously cited for a violation of this occupational safety and health standard and or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1088128, citation number 01, item number 001 and was affirmed as a final order on November 3, 2015, with respect to a workplace located at 12121 Zavi Dr., El Paso, TX 79934.

29 CFR 1926.503(c)(3): When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill, the employer shall retrain the affected employee: Construction Site: On or about September 5, 2017, The employer did not ensure employees retained the requisite understanding to recognize the hazards of falling. This condition exposed employees to fall hazards of more than 6-ft. to the ground below.
