29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.   On or about 8 September 2017, and at times prior thereto, workers were performing roofing activities at an apartment complex with multiple buildings without hard hats, exposing the workers to the hazard of being struck by falling materials, tools or debris while on the ground.

On or about 8 September 2017, and at times prior thereto, workers were raised and lowered while in a Genie S-60 Aerial Boom Lift up to the third story roof of apartment complexes without being tied in, exposing the workers to a fall hazard of up to approximately 30 feet 6 inches in height.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval.  On or about 8 September 2017, and at times prior thereto, roofers were working with two telehandler forklifts to move materials, trash, and personnel to and from the roofs of two apartment buildings with unapproved fork mounted personnel work platforms, job-site made, wooden trash boxes supported by the forks of each rough terrain forklift. The trash boxes were elevated to upper levels, a height of 30 feet or higher, of each of two apartment buildings which were having the roofs replaced, exposing the workers to the hazard of falling from a height of more than 30 feet. 1) Building 1 had a JLG Skytrak Telehandler with a job-made, wooden trash box attached by two nylon straps. Building 1 had a 3-story roof. 2) Building 2 had a Genie GTH-1056 Telehandler with a job-made, wooden trash box attached by two tie-down straps. Building 1 had a 3-story roof.
