29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest systems. On 8/14/2017, employees from Top Notch Aesthetics, LLC were removing roofing materials from the roofs of residential buildings located in Lake St. Louis, MO. They were not utilizing guardrail systems, a safety net system, or personal fall arrest systems. The following instances existed: a) Four employees were observed removing roofing materials on several residences located at 171-176 Harbor View Drive in Lake St. Louis, MO. They were on a 5/12 sloped roof approximately twelve feet above the ground without fall protection, exposing them to a fall to the ground below. b) Five employees were observed removing roofing materials on several residences located at 41-47 Breezy Knoll Lane in Lake St. Louis, MO. They were on a 4/12 sloped roof approximately seventeen feet above the ground without fall protection, exposing them to a fall to the ground below.
