29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) On or about 9/07/17, at 700 South 19th Street, Birmingham, AL; the employer had not developed a written program. The written program should include a list of chemicals known to be present that employees have potential exposures.  The list should use an identity that is referenced on the appropriate safety data sheet. The employees assigned to janitorial tasks were exposed to chemicals that were contained in floor strippers, floor wax and cleaners.

29 CFR 1910.1200(e)(2): The employer that produced, used, or stored hazardous chemicals at the workplace in such a way that employees of other employer(s) could be exposed did not ensure that the hazard communication program included all of the elements outlined in 29 CFR 1910.1200(e)(2)(i) through 29 CFR 1910.1200(e)(2)(iii):   a) On or about 9/7/17, at 700 South 19th Street, Birmingham, AL site; janitorial services conducted at the site required the use of chemical products during housekeeping and floor maintenance.  These products were utilized in areas where host employees worked. The employer had not developed written procedures for the sharing of information and the methods developed to convey information on the multi-employer site. The program should address procedures developed to protect employees during normal operating conditions or in forseeable emergencies.

The employer had not inspected and assured the adequacy of the footwear and tread of the boot being worn.
