Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to drowning hazards when using an elevator during catastrophic flooding: a) At the facility, on or about August 27, 2017, elevators were kept operational during a 1000-year flood event, allowing employees to be exposed to drowning hazards. Among other methods, feasible and acceptable abatement methods to correct this hazard are to: 1. During 1000-year flood event, take the elevators out of operation. 2. During 100-yeah flood event, post signs at the elevators prohibiting their use.
