29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  WORKSHOP/PRODUCTION AREA:  The guard, installed for the lower portion of the auger of the Olive Pitting Machine did not prevent entry of hand(s) or fingers into the rotating augur by reaching through, over, under or around the guard.     On/or about September 05, 2017, an employee was able to put a hand into shoot while sweeping the floor, and the employee's hand got caught on the rotating augur of the machine. The incident resulted a finger amputations to the right hand.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  WORKSHOP:  The employer had not verified through a written certification that the Workplace Hazard Assessment for personal protective equipment (PPE) had been performed as complete.

29 CFR 1910.1030(f)(1)(i): The employer shall make available the hepatitis B vaccine and vaccination series to all employees who have occupational exposure, and post-exposure evaluation and follow-up to all employees who have had an exposure incident.  WORKSHOP:  The employer had not made available a Hepatitis B vaccine and vaccination series for the employee, who responded to and was potential exposed to blood and/or bodily fluids from the incident happened on September 5, 2017 where an employee sustained a finger amputation.
