29 CFR 1910.178(l)(1)(ii):  Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the training.    On 8/24/2017, The Billy Goat Chip Company LLC had not ensured that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training.  Employees were operating a Yale, model: GLC030AENUAE083 powered industrial truck without completing training.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not conducted at least once every three years.  On 8/24/2017, The Billy Goat Chip Company LLC located at 3136 Watson Road, Saint Louis, Missouri was operating a Yale Forklift, Model GLC030AENUAE083, Serial N524811 without having completed the required refresher training.  Employees were using training cards from previous employers as certification, but had not completed the 3 year refresher training/evaluation since.

The employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    On 8/24/2017, The Billy Goat Chip Company LLC located at 3136 Watson Road, Saint Louis, Missouri, had not established a program consisting of energy control procedures, employee training and periodic inspections for the Urschel Model CC potato slicer.
