29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) Leitner Poma on CO RD 751 Breckenridge, CO 80424: On or before 9/11/2017, the controlling, creating, correcting and exposing employer did not protect employees from injury in that they did not ensure that excavated materials were kept at least two feet from the edge of the excavation. The crew was excavating in order to set footings for a new ski lift tower. This condition exposed employees to falling objects and the potential for the excavation to be filled with debris.
