29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)    Working above the garage:  Employee without any fall protection fell between two floor joists approximately 16" apart when installing 1/2 inch 4 foot by 8 foot sheets of subflooring on the floor joists above the garage, on or about 09/07/2017.  b)    Working above rear of garage:  Employee without any fall protection was working at the edge of the 1st story roof, approximately 10 feet above the ground, on or about 09/12/2017;  c)    Working above the garage:  Employee working from a step ladder next to the approximate 3 foot x 4 foot rough window opening approximately 13 feet above the ground, on or about 09/12/2017.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:  a)    Job site, 2213 Beverly Road:     The employer did not provide fall protection training to the employees on the recognition of fall hazards and the procedures to follow to minimize these hazards, observed on or about 09/12/2017.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a)  Room addition above garage at 2213 Beverly Road, Cinnaminson, NJ, north side of house: The side rails for the 22 Model 1000 Scranton Aluminum Mfg. Co. Aluminum Type III extension ladder used by employees to access the second floor from the outside of the house did not extend at least 3 feet above the surface being accessed, on or about 09/12/2017.   NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
