29 CFR 1926.1203(a): Each employer did not ensure that a competent person identified all confined spaces and identified each space that was a permit space, through consideration and evaluation of the elements of each that space, including testing as necessary: Jobsite located at the Millstone Power Station, Rope Ferry Road, Waterford, Connecticut: On, or about, July 3, 2017, the Confined Space Evaluation for each of the following spaces did not account for hazards in each space that had not been eliminated/isolated: A. Manhole 21: Although this confined space was classified as a permit-required confined space due the proximity of the storage and use of inert gases, the potential fire, smoke and shock hazards created by employees performing work in live cable trays and conduits was not considered to be a serious hazard during the evaluation of the space. B. Manhole 2: Although this confined space was classified as a permit-required confined space due the proximity of the storage and use of inert gases, the potential fire, smoke and shock hazards created by employees performing work in live cable trays and conduits was not considered to be a serious hazard during the evaluation of the space. C. Manhole 11: This space was not determined to be a permit-required space although employees were required to perform work in live cable conduits to pull new cables, employees had to touch live cables to enter and exit the space, the floor was wet and the surface conditions were poor due to the presence of an elevated berm, concrete wall and awkward access and egress from the space. D. Manhole 32: This space was not determined to be a permit-required space although employees were required to perform work in live cable conduits to pull new cables, employees had to touch abandoned coils of hanging cable and the floor was wet.

29 CFR 1926.1211(c)(2): A mechanical device was not available to retrieve personnel from vertical type permit spaces more than 5 feet (1.52 meters) deep: Jobsite located at the Millstone Power Station, Rope Ferry Road, Waterford, Connecticut: On, or about, dates from July 10, 2017 through September 7, 2017, employees entered the following permit required confined spaces for the Open Phase Project. Mechanical retrieval equipment had not been set-up and staged at the point of entry to be ready for use in the event a rescue from the space was needed: A. Manhole 21. B. Manhole 2. C. Manhole 11. D. Manhole 32.
