Except as provided elsewhere in this section or by other subparts of 29 CFR part 1910, the employer must ensure each employee on a walking-working surface 4 feet (1.2 m) or more above a lower level is protected from falling by:    (a) On September 13, 2017, an employee was exposed to a fall distance of approximately 11 feet as the employee climbed the storage rack to retrieve boxes in the east end of the warehouse.    (b) On September 13, 2017, an employee was exposed to a fall distance of approximately 11.5 feet as the employee climbed the storage rack to retrieve boxes in the west end of the warehouse.

29 CFR 1910.30(a)(1): (a) Fall hazards. (1) Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employees place a wooden pallet that is not specifically designed by the manufacturer for such use on the forks of the forklift to ride it up to pick boxed material above ten feet.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.    Employees were standing on a pallet on the forks of the forklift at heights greater than ten feet where the employer has not provided any type of fall protection for employees working from the scaffold.
