29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access;   On or about; September 13, 2017  Location: Inclined roof side of the apartments building, located at Crescent Drive, Talleyrand Apartments, Tarrytown NY   a) Seven employees engaged in residential roofing renovation activities, tearing down the roof and installing new Timberland HD shingles (more than 18 feet above the ground) used a ladder extended only 2ft above the upper landing surface to gain access to the roof.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system:  On or about; September 13, 2017 Location: Top of inclined roof ; Elevation from ground level: two stories at front  side and three stories on the rear side of the apartments building, located at Crescent Drive, Talleyrand Apartments, Tarrytown NY  a) Seven employees engaged in residential roofing renovation activities, tearing down the roof and installing new Timberland HD shingles while standing on the roof (more than 18 feet above the ground) were not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems.  1st Repeat: JKG Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) which was contained in OSHA inspection number 1166912, citation number  1, item number 1 and was affirmed as a final order on 9/23/16, with respect to a workplace located at  2467 Route 10 East Building #26, Morris Plains, NJ.
