The employer is failing to instruct employees in the recognition and avoidance of electrical hazards. This condition was most recently observed on or about September 6, 2017, at 312 Cookshire Lane, Chesterfield, Missouri when employees worked with conductive equipment in proximity of 34.5 kV electrical sub-transmission lines.

29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means:  The employer is failing to prevent employee exposure to contact with electricity. The condition was most recently observed on or about September 06, 2017, at 312 Cookshire Lane, Chesterfield, Missouri. The employer did not ensure that overhead 34.5 kilovolt outer phase powerlines were guarded by insulation or other means. Employees used electrically conductive, aluminum poles during concrete finishing work. The poles measured approximately 23 feet in combined length. The overhead powerline measured approximately 21 feet 9 inches from the work surface. An employee suffered fatal injuries as a result of this condition.

29 CFR 1926.416(a)(3): Before work began, the employer did not ascertain by inquiry, direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, was so located that the performance of the work could bring any person, tool, or machine into physical or electrical contact with the electric power circuit.     The employer is failing to prevent employee exposure to contact with electricity. The condition was most recently observed on or about September 06, 2017, at 312 Cookshire Lane, Chesterfield, Missouri. Employees used a series of four electrically conductive, aluminum, poles during finishing work on a newly poured concrete driveway. The connected poles measured approximately 23 total feet in length. The 32 foot by 24 foot section of concrete was beneath a 34.5 kilovolt overhead powerline that was approximately 21 feet 9 inches above the work surface. An employee suffered fatal injuries when the electrically conductive pole contacted the 34.5 kilovolt overhead powerline.

Bull float handles used where they might contact energized electrical conductors, shall be constructed of nonconductive material or insulated with a nonconductive sheath whose electrical and mechanical characteristics provide the equivalent protection of a handle constructed of nonconductive material.     The employer is failing to prevent employee exposure to contact with electricity.  The condition was most recently observed on or about September 06, 2017, at 312 Cookshire Lane, Chesterfield, Missouri. Employee(s) used electrically conductive, aluminum poles during concrete finishing work. The poles measured approximately 23 feet in combined length. The overhead powerline measured approximately 21 feet 9 inches from the work surface. An employee suffered fatal injuries as a result of this condition.

29 CFR 1904.39(a)(1): The employer did not report within 8 hours of the death of an employee resulting from a work-related incident:  The employer is failing to report a work-related fatality within 8 hours.  Most recently, on or about September 06, 2017, at 312 Cookshire Lane, Chesterfield, MO an employee was injured in a work-related incident and subsequently passed away in the hospital on September 09, 2017.  Notification of the fatality was made approximately 7 days after the incident on September 13, 2017.
