29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:                                                     AND/ OR IN THE ALTERNATIVE    29 CFR 1910.95(d)(1): When information indicated that any employee's exposure to noise equaled or exceeded the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    (a) On or about September 18, 2017 at various law enforcement firing ranges and training facilities, the ATF did not implement a monitoring program or hearing conservation program for Special Agents, who are required to perform weapons qualifications at a firing range four times per year for two hours. Special Agents also receive 50 hours of explosives simulation training at their training facility. Hearing protection is required to be worn for both to protect Special Agents from hearing damage due to continuous noise over 85dB and impulse noise over 140dB.                                                                               The Bureau of Alcohol, Tobacco, Firearms, and Explosives was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.95(d)(1) and/or  (c)(1), which was contained in OSHA inspection number 1210976, citation number 1, item number 1 and was affirmed as a final order on June 5, 2017 with respect to a workplace located at 201 East Washington, Suite 940, Phoenix, AZ 85004.

29 CFR 1910.1020(g)(1): The employer did not inform current employees upon their first entering in to employment and at least annually thereafter, of the existence, location, and availability of any records covered by 29 CFR 1910:     (a) On or about September 18, 2017 at the Bureau of Alcohol, Tobacco, Firearms and Explosives, employees had medical surveillance performed, and previous and current exposure to chemicals such as tear gas and MC#7 Bore Cleaner. The employees had not received information on their rights to access medical and exposure records that meets the requirements of 1910.1020(g)(1)(i) through 1910.1020(g)(1)(iii).
