29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):      Allen Service, Inc., 519 S. Loomis Avenue, Fort Collins, CO:  On and prior to September 15th, 2017, the employer did not ensure that employees working in an excavation were protected from cave-in hazards.  Employees were working in a trench that was up to 6' deep, 3' wide, and 10' long, with vertical walls, without an adequate protective system.  This condition exposed employees to cave-in hazards.

29 CFR 1926.651(k)(1): An inspection of an excavation, the adjacent areas, and protective systems was not conducted by a competent person prior to the start of work and as needed throughout the shift:    a)  Allen Service, Inc., 519 S. Loomis Avenue, Fort Collins, CO:  On and prior to September 15th, 2017, the employer did not ensure that a competent person conducted a comprehensive inspection of a trench prior to allowing employees to enter it.  The trench was up to 6' deep, 3' wide, and 10' long, with vertical walls, and did not have an adequate protective system.  This condition exposed employees to cave-in hazards.          Abatement Note:  "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)   a)  Allen Service, Inc., 519 S. Loomis Avenue, Fort Collins, CO: On and prior to September 15th, 2017, the employer did not develop, implement, and/or maintain a written hazard communication program.  Employees were exposed to chemical hazards including but not limited to Hammerhead Epoxy and Hammerhead Epoxy Hardener.    Abatement Note: The employer shall ensure a written Hazardous Communication Program is equipped with the following elements:   1)     A list of the hazardous chemicals known to be present in the workplace;    2)     Labels and/or other forms of warning secured to containers into which hazardous chemicals were transferred;     3)     Material safety data sheets for each hazardous chemical utilized in the workplace; and    4)     Provide employees with effective information and training on hazardous chemicals in their work area on initial assignment and whenever a new physical or health hazards is about to be introduced.

Loomis Avenue, Fort Collins, CO: On or prior to September 15th, 2017, the employer did not maintain a list of the hazardous chemicals and/or products used at the worksite.  Employees utilize chemicals typically associate with plumbing, heating, and cooling applications such as, but not limited to, Hammerhead Epoxy and Hammerhead Epoxy Hardener.  This condition exposed employees to the physical hazards associated with the use of these chemicals.

Loomis Avenue, Fort Collins, CO:  On or prior to September 15th, 2017, the employer did not maintain a copy of a Safety Data Sheet (SDS) for each hazardous chemical in the workplace.  Employees were using Hammerhead Epoxy and Hammerhead Epoxy Hardener without having the safety data sheets available.  This condition exposed employees to physical hazards associated with the use of these chemicals.
