29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: On or about September 14, 2017, the employer failed to obtain written approval from the manufacturer of the Toyota powered industrial vehicle (serial #61421, large orange), for their use of an attachment that was being used to lift and carry various sized wire spools/bundles that weigh upwards of 800 pounds each, to various locations in the facility for use on machines. This attachment slid onto the forks of the vehicle and had a "claw like" end attachment that would attach to the wire spools for transport.

29 CFR 1910.178(n)(4): Industrial truck driver(s) were not required to travel with the load trailing whenever the load obstructed forward view: On or about September 14, 2017, the employer failed to ensure that a powered industrial vehicle operator was operating his vehicle with his load trailing behind him due to the forward line of travel being significantly obstructed by the load that was being carried. This powered industrial vehicle (large orange Toyota, serial #61421) was designed such that the only clear line of travel would always be with the load trailing.
