29 CFR 1910.146(c)(1): The employer shall evaluate the workplace to determine if any spaces are permit-required confined spaces.     On September 12, 2017 equipment such as but not limited to the dust collector was not determined to be a permit-required confined space, in that the employer did not evaluate the work place to determine if any spaces were permit-required confined spaces.

29 CFR 1910.146(c)(4): If the employer decides that its employees will enter permit spaces, the employer shall develop and implement a written permit space program that complies with this section. The written program shall be available for inspection by employees and their authorized representatives.    On September 12, 2017 employees were entering a permit-required confined space through an access panel on the dust collector without a developed, implemented, and written permit space program supplied by the employer.

29 CFR 1910.146(g)(1): The employer shall provide training so that all employees whose work is regulated by this section acquire the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under this section.    On September 12, 2017 employees were not provided training to enter permit required confined spaces that gave them the understanding, knowledge and skills necessary to safely clean the rotary airlock feeder in the ACT Dust Collector by crossing the plane and reaching down into the dust collector.

29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.   Employees performing servicing and maintenance on the rotary airlock feeder in the dust collector were not required to:    (1)  Know the type and magnitude of the energy, the hazards of the energy to be controlled, and the method or means to control the energy,  (2) turn off and shut down the machine  (3)  physically locate and operate the energy isolating devices in such a manner as to isolate the machine or equipment from the energy source,  (4) affix lockout or tagout devices to each energy isolating device,  (5) prior to starting work on machines that have been locked out or tagged out, verify that isolation and deenergization of the machine or equipment have been accomplished.    On September 12, 2017, employee's cleaning the rotary airlock feeder were exposed to a caught-in hazard in that the electric power to the rotary airlock feeder was not disconnected.
