29 CFR 1926.651(g)(1)(i): Where oxygen deficiency (atmospheres containing less than 19.5 percent oxygen) or a hazardous atmosphere exists or could reasonably be expected to exist, such as in excavations in landfill areas or excavations in areas where hazardous substances are stored nearby, the atmospheres in the excavation shall be tested before employees enter excavations greater than 4 feet (1.22 m) in depth. a. Intersection of Springfield Ave and Boyden Pkwy Maplewood, NJ The employer does not ensure that the atmosphere is tested in the excavation in that employees were working in a trench excavation in close proximity to leaking natural gas pipe, employer were there by exposed to asphyxiation and explosion hazards from gas fumes. Violation occurred on or about 09/18/2017
