29 CFR 1926.502(h)(1): The employer did not designate a competent person to monitor the safety of other employees and/or did not ensure that the safety monitor complied with the requirements listed in (h)(1)(i) through (h)(1)(v) of this section: (a) First Floor above Ground Level - Employees worked 14 feet above ground level grouting the hollow core precast concrete planks at the building's east end. The employer's written fall protection plan specified using a safety monitoring system and controlled access zone as alternative fall protection; however, the crew failed to follow the employer's alternative fall protection plan in that there was no safety monitor, exposing employees to the hazard of falling to a lower level, on or about September 19, 2017. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement

29 CFR 1926.502(k)(4): The implementation of the fall protection plan was not under the supervision of a competent person: (a) First Floor above Ground Level - Employees worked 14 feet above ground level grouting the hollow core precast concrete planks at the building's east end. The competent person did not supervise the employer's written fall protection plan, in that the fall protection plan specified using a controlled access zone and safety monitoring system; however, the grouting operation had an improperly erected control line and no safety monitor, creating fall hazards to a lower level, on or about September 19, 2017. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement

29 CFR 1926.502(g)(1)(i): When control lines were used, they were erected less than 6 feet (1.8 m) or more than 25 feet (7.7 m) from the unprotected or leading edge: (a) First Floor above Ground Level - Employees worked 14 feet above ground level grouting the hollow core precast concrete planks at the building's east end. The employer's written fall protection plan specified using a safety monitoring system and controlled access zone as alternative fall protection; however, the crew failed to follow the employer's alternative fall protection plan in that the employees erected a control line at the unprotected edge along the stairwell opening, rather than erecting the control line not less than 6 feet (1.8 m) back from this unprotected edge, on or about September 19, 2017. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement
