29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation were performed by the employer without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals were not changed accordingly. Federal Administration Aviation- Sacramento (FAA): The employer attached a 69-inch long fork extension to their forklift (Hyster 65) to move a mobile engine generator trailer (Kohler Power System, 12,000 pounds) without the manufacturer's prior written approval which changed the capacity of the forklift and the moving force.

General-duty citation text
29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. Federal Administration Aviation- Sacramento (FAA): An effective hearing conservation program was not administered for employees who work in potentially high noise areas such as runways/tarmac and operate the engine generator. According to the site specific PPE Hazard Assessment and Hearing Conservation Program, employees are responsible for determining when hearing protection is needed.
