29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about September 20, 2017 the employer failed to ensure that employees who were working on the second and third levels of an apartment complex exterior balcony (building 15 &16) that was under construction, were protected from a fall from a height of up to 24 feet approximately. Employees were not wearing a personal fall protection harness and other means of fall protection was not in place.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge: On or about September 20, 2017 the employer failed to ensure that employees who were working on the second and third levels of an apartment complex exterior walkway and balcony (building 15 &16) that was under construction, were protected from a fall from a height of approximately 12 feet. Employees were using a stairway that had an unprotected side to access the second and third level floor landings and walk ways in order to put up siding on the exterior walls. The stairway hand rail was removed.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: On or about September 20, 2017 the employer failed to ensure that employees who were working on the second and third levels of an apartment complex exterior balcony (building 15 &16) that was under construction, were protected from a fall from a height of up to 24 feet approximately. Employees were accessing these upper levels via a portable ladder that was not extended at least three feet above to upper landing surface. The top of the ladders were nearly flush with the landing.
