29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: A.) John A. Miller Construction, LLC, 5100 Buffalo Road, Erie, PA 16510, south side of the structure, on or about September 20, 2017 and times prior thereto: Employees were performing work activities including, but not limited to, installing the overhang on the front side (south side) of the building. The employee was working in the basket of a Haulotte HB44J aerial lift. The employee was not utilizing personal fall arrest, body belt and/or a lanyard when working in the basket of the aerial lift.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: A.) Miller Construction, LLC, 5100 Buffalo Road, Erie, PA 16510, south side of the structure, on or about September 20, 2017 and times prior thereto: Employees were performing work activities including, but not limited to, installing the overhang on the front side (south side) of the building. The employee was working at edge and was exposed to a fall hazard of 21.9-feet. The employee was not utilizing a means or method of fall protection.
