OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a) On or about September 28, 2017 and at times prior to, two employees were checking the grade of a new road to a construction site and walking beside a tractor (motor grader). The employees were not wearing reflective vests as a result, were exposed to being struck-by and crushed.
