29 CFR 1926.501(b)(1):  Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet or more above a lower level was not  protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems and/or other suitable fall protection systems:     a) Builder Services Group, Inc. dba Mato at 3355 County Road 27, Fort Lupton, Colorado 80621:  On or before September 22, 2017, the exposing employer did not ensure that employees installing insulation near the roof, with an unprotected side or edge of 6 feet or more above a lower level, were protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Employees were installing insulation near the roof without adequate fall protection.  An employee sustained serious injury when he fell approximately 24 feet to the concrete floor below.  This condition exposed employees to fall hazards.

29 CFR 1926.502(d)(8):  Horizontal lifelines were not designed, installed, and used under the supervision of a qualified person, as part of a complete personal fall arrest system, which maintains a safety factor of at least two:    a) Builder Services Group, Inc. dba Mato at 3355 County Road 27, Fort Lupton, Colorado 80621:  On or before September 22, 2017, the exposing employer did not ensure that horizontal lifelines were designed, installed, and used under the supervision of a qualified person, as part of a complete personal fall arrest system, which maintains a safety factor of at least two.  Employees were installing insulation near the roof without adequate fall protection.  A horizontal lifeline was set up for their use that was not designed, installed, and used under the supervision of a qualified person, as part of a complete personal fall arrest system, which maintains a safety factor of at least two.  On September 22, 2017, an employee sustained serious injury when he fell approximately 24 feet to the concrete floor below.  This condition exposed employees to fall hazards.    Note: "29 CFR 1926.32(m) states:  Qualified Person is defined as one who, by possession of a recognized degree, certificate, or professional standing, or who by extensive knowledge, training and experience, has successfully demonstrated his ability to solve or resolve problems relating to the subject matter, the work, or the project."

29 CFR 1926.502(d)(21): Personal fall arrest systems were not inspected by a competent person prior to each use for wear, damage, proper installation, and usage as appropriate:    a) Builder Services Group, Inc. dba Mato at 3355 County Road 27, Fort Lupton, Colorado 80621:  On or before September 22, 2017, the exposing employer did not ensure the personal fall arrest systems were inspected by a competent person for appropriate design installation and usage.  Employees were installing insulation near the roof without adequate fall protection.  The personal fall arrest systems were not inspected by a competent person prior to each use for wear, damage, proper installation and usage as appropriate.  On September 22, 2017, an employee sustained serious injury when he fell approximately 24 feet to the concrete floor below.  This condition exposed employees to fall hazards.    Note "competent person" is defined as "one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them."

1926.503(a)(2): The employer did not assure that each employee has been trained, as necessary, by a competent person to enable each employee to recognize the hazards of falling, and the procedures to be followed in order to minimize these hazards:      a)  Builder Services Group, Inc. dba Mato at 3355 County Road 27, Fort Lupton, Colorado 80621:  On or before September 22, 2017, the exposing employer did not ensure that each employee had been trained, as necessary, by a competent person to enable the employees to recognize the hazards of falling, and the procedures to be followed in order to minimize these hazards.  Employees were installing insulation near the roof without adequate fall protection.  Employees were not adequately trained, as necessary, by a competent person to enable each employee to recognize the hazards of falling, and the procedures to be followed to minimize these hazards.  On September 22, 2017, an employee sustained serious injury when he fell approximately 24 feet to the concrete floor below.  This condition exposed employees to fall hazards.    Abatement note "competent person" is defined as "one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.    Abatement note:  29 CFR 1926.503(a)(2)(i) through (viii) provide that the training should include the following areas:     1. The nature of fall hazards in the work area;    2. The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;    3. The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems,   safety monitoring systems, controlled access zones, and other protection to be used;    4. The role of each employee in the safety monitoring system when this system is used;    5. The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;    6. The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and    7.  The role of employees in fall protection plans; and    8.  The standards contained in this subpart.

The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training:    a)  Builder Services Group, Inc. dba Mato at 3355 County Road 27, Fort Lupton, Colorado 80621:  On or before September 22, 2017, the exposing employer did not verify compliance with paragraph (a) of this section by preparing a written certification record.
