29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.   a. On or about October 3, 2017, the employer had not developed and documented a workplace hazard assessment certification in order to identify the hazards present or likely to be present at the facility and the personal protective equipment (PPE) required to be utilized.

The employer shall ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear will protect the affected employee from an electrical hazard, such as a static-discharge or electric-shock hazard, that remains after the employer takes other necessary protective measures.   a. On or about October 3, 2017, the employer did not provide foot protection for employees exposed to crushing hazards.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.    a. On or about October 3, 2017, employees were operating a CAT, Model EP6000, Serial FN408254, forklift equipped with a JibRig boom lifting attachment to handle granite slabs. The employer did not receive written approval from the equipment manufacturer for the use of the attachment and update the data plate on the forklift.       b. On or about October 3, 2017, employees were operating a CAT, Model DP70, Serial T20C-607, forklift equipped with a shop made boom lifting attachment to handle granite slabs. The employer did not receive written approval from the equipment manufacturer for the use of the attachment and update the data plate on the forklift.

29 CFR 1910.178(o)(1): Only stable or safely arranged loads shall be handled. Caution shall be exercised when handling off-center loads which cannot be centered.    a. On or about October 3, 2017, and at times prior thereto, the employer did not ensure employees were protected while moving granite slabs with the Wesco JibRig forklift boom lift attachment. The lifting attachment was not secured to the carriage of the forklift to prevent displacement from the forks, exposing employees to a crushed by hazard.                                                                                      b. On or about October 3, 2017, and at times prior thereto, the employer did not ensure employees were protected while moving bundles of granite slabs with a fabricated steel forklift boom lift attachment. The lifting attachment was not secured to the carriage of the forklift to prevent displacement from the forks, exposing employees to a crushed by hazard.
