29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a.) On or about October 3, 2017, the employer did not ensure a program consisting of energy control procedures, employee training, and periodic inspections was implemented. Employees were required to perform setup activities on the Mazac Super Turbo-X48 MkII laser and were exposed to hazards from unexpected start up of the equipment.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a.) On or about October 3, 2017, the employer did not ensure employees were protected while operating Mazak Super Turbo-X48 MkII. Employees are required to work around and enter the gated area for the laser and are exposed to struck by hazards from the feeder in that the gate interlocks are disabled. a.) On or about September 25, 2017, the employer did not ensure employees were protected while operating the Mazak Super Turbo-X48 MkII. An employee was unloading a finished part, while a new part was on the laser table, when his finger became caught between the part caught on the indexing table and the side of the machine, resulting in a finger amputation.
