29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:       a) On or about 10/02/17, on the front side of the Holiday Inn Express Construction Site, 2382 Niagara Falls Boulevard Tonawanda, NY: Three employees in the elevated basket of a JLG aerial lift while being transported from the roof to the ground were exposed to a fall of up to approx. 35 foot. All of the employees were wearing full body harnesses, but none of them had a lanyard connected to their harness, and none were tethered to the boom or basket of the lift in any other way.        NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:      a) On or about 10/02/17, on the roof of the Holiday Inn Express Construction Site, 2382 Niagara Falls Boulevard Tonawanda, NY: Two employees engaged in roofing work were exposed to a fall of approx. 35 foot. Both employees were wearing full body harnesses, but neither was tied off to a lifeline/anchor point, and no other fall protection system was utilized. The roof pitch was 5 in 12.      NO ABATEMENT DOCUMENTATION REQUIRED           Roofing Consultants, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(11), which was contained in OSHA inspection number 1131640, citation number 1, item number 1, and was affirmed as a final order on April 8, 2016, with respect to a workplace located at 1 Flint Road, Amherst, NY 14226.       Roofing Consultants, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 991286, citation number 1, item number 1, and was affirmed as a final order on October 1, 2014, with respect to a workplace located at 455 Center Road, West Seneca, NY 14206.
