29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): 649 Grove St., Montclair, NJ a) Employees performing tarping of dormers with openings were not protected from falling approximately 20 feet to the ground below by any means of fall protection. b) Employees accessed the second floor mezzanine to perform window framing. The employees were not protected from falling 8.5 feet to the floor below by any means of fall protection. Violation occurred 9-28-17 Olinda's General Contractor was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1011246, citation number 1, item number 2, and was affirmed as a final order on 4-6-15, with respect to a workplace located at 52 W. Newell Avenue, Rutherford, NJ 07070.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge: Carpenters used a stairway without stair rails on either side to access the second floor landing to perform window framing, and were exposed to a fall to ground of approximately 8.5 feet.
