OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to fall crushing and struck-by hazards:      a)  On October 3, 2017, employees were permitted to ride the bucket of an excavator to and from a trench having a depth of approximately 5.4 feet.        Feasible and acceptable methods of abatement to correct this hazard include, but are not limited to the following:    (1) Conform to the Association of Equipment Manufacturers for Hydraulic Excavators.    (2) Conform to the Bobcat Operator's Manual for Bobcat E35i.    (3) Provide employees with a safe means of access/egress when working in a trench, i.e., extension ladder.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
