29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) 1712 Broad Street, Selma AL; On or about October 4, 2017 the employer exposed employees to cave-in and struck-by hazards in that employees were required to work inside a 7 foot trench that had a 5 to 8 foot tall spoil pile located on the edge of the trench which was not retained or otherwise prevented from being able to fall or roll back into the excavation.

29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61 m) below the bottom of the members of a support system shall be permitted, but only if the system is designed to resist the forces calculated for the full depth of the trench, and there are no indications while the trench is open of a possible loss of soil from behind or below the bottom of the support system. a) 1712 Broad Street, Selma AL; On or about October 4, 2017 the employer exposed employees to cave-in and struck-by hazards in that employees were required to work inside a trench box that was set 3 feet above the bottom of the trench - material was excavated greater than 2 feet below the bottom of support members.
