29 CFR 1926.503(a)(2)(iii): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used. On or about October 10, 2017 at 1760 Eldorado Drive in Green Bay, the employer did not ensure that fall protection safety training had been provided to an employee prior working on roof surfaces at greater than 6 ft. above surface level.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. On October 10, 2017 at 1760 Eldorado Drive in Green Bay, employees were working on a roof surface and at roof edge 16.5 ft. above surface level without utilizing fall protection equipment. Top Tier Roofing & Siding was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1210734, citation number 01, item number 001 and was affirmed as a final order on March 13, 2017 with respect to a workplace located at Alexandra Way; Greenville, Wisconsin 54942.
