29 CFR 1926.95(a): The employer did not ensure protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment that chemical hazards are encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption or physical contact: (a)Huber Contracting, Inc. at the Fort Randall Dam at 399 Powerhouse Road, Pickstown, SD 57367: On or about October 2, 2017, and at times prior, the exposing employer did not ensure use of appropriate hand protection for employees applying Spectrum 1 Caulking in combination with xylene. This condition exposed employees to skin irritation hazards.

29 CFR 1926.454(b): The employer did not ensure each employee who is involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold was trained by a competent person to recognize any hazards associated with the work in question: a) Huber Contracting, Inc. at the Fort Randall Dam at 399 Powerhouse Road, Pickstown, SD 57367: On or about October, 2, 2017 and at times prior, the exposing employer did not ensure employees installing, moving, and operating the Spider suspended scaffold system had been trained on the nature of scaffold hazards, the design criteria of the scaffold system, and correct procedures for installing, moving and operating the scaffold system. This condition exposed employees to hazards associated with operation of scaffolds when employees utilized the Spider suspension system to remove and reapply caulking up to 80 feet above a lower level on the Powerhouse.
