At residential construction sites, the employer did not conduct inspections of job sites to provide a workplace were any employee, worker, laborer or mechanic employed in the performance of the contract were free from recognized hazards such as but not limited to the use of fall protection and proper guardrail construction and installation.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. At residential construction sites, the employer did not ensure that employees working over 6 feet were provided fall protection such as but not limited to guard rail systems or personal fall protection exposing them to unprotected fall hazards.
