29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:    (a) Liberty Stucco, 2101 County Road 10, Erie, CO 80516:  On and before October 5, 2017, the exposing employer did not ensure that a competent person was designated to conduct frequent and regular inspections to identify and correct hazardous conditions capable of causing injury.  Employees had been working adjacent to a open window well for over one month without a competent person inspection.  This condition exposed workers to fall hazards.    Abatement note:  OSHA defines a "competent person" as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to workers, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:  (a) Liberty Stucco at 2101 County Road 10, Erie, CO 80516:  On or before 10/05/17, the employer did not ensure that employees were protected from falling into holes more than 6 feet deep.  Employees had constructed scaffolding and were performing stucco work adjacent to a window well measuring approximately 7 feet deep.  The employees were exposed to fall hazards in that no personal fall arrest systems, covers, or guardrails were in place.  This condition exposed employees to a fall hazard of approximately 7 feet.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms:    (a)  Liberty Stucco at 2101 County Road 10, Erie, CO 80516:  On or before 10/05/17, the employer did not ensure that guardrail systems were installed along all open sides and ends of platforms.  Employees were performing stucco work on scaffolds that were missing mid-rails and end-rails at the east and west ends of the scaffolding.  Employees were exposed to fall hazards of approximately 11 feet 4 inches.

29 CFR 1926.454(b): The employer did not have each employee who is involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question:  a)  Liberty Stucco at 2101 County Road 10, Erie, CO 80516:  On or before October, 5 2017, the employer did not ensure that employees who were involved in the erection, moving, and maintaining scaffold were provided training by a competent person.  The employer allowed employees to perform stucco operations on scaffold, and to erect, move, and maintain scaffold without adequate training.  This condition exposed employees to fall hazards.
