29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information in paragraph (d) of this section) before use: (a) On or about November 1, 2017 and at times prior, for employees exposed to potential respiratory hazards where piping within the reactor control house at a t-union and a flange leaked anhydrous ammonia at or near, 3447 80th Avenue SE in Jamestown, North Dakota. (b) On or about November 1, 2017 and at times prior, for employees exposed to potential process hazards where piping at a t-union within the reactor control house displayed evidence of paint coating failure, corrosion, and inadequate repair at or near, 3447 80th Avenue SE in Jamestown, North Dakota.

29 CFR 1910.119(d)(3)(i)(B): The employer's piping and instrument diagrams were not accurate and did not represent equipment that was existing and was part of the process: (a) On or about November 1, 2017 and at times prior, for employees exposed to potential process hazards where the employer included various valves in the piping system adjacent to flow indicators two and three that where not included in the 10-34-0 liquid fertilizer production schematic at or near, 3447 80th Avenue SE in Jamestown, North Dakota. (b) On or about November 1, 2017 and at times prior, for employees exposed to potential process hazards where the employer included an unlabeled bypass valve adjacent to manual globe valve ALV11 on the 10-34-0 liquid fertilizer production schematic at or near, 3447 80th Avenue SE in Jamestown, North Dakota.
