29 CFR 1910.178(p)(1):  Powered industrial truck(s) with defect(s) or in any way unsafe had not been withdrawn from service until restored to safe operating condition(s):                                               a)    This violation was discovered on October 10, 2017; where at least one (1) Taylor (m/n Y-20-WOM, s/n 1-69-4807) forklift was in need of seat belt; horn not operational and no backup alarm to warn others of movement;       b)    This violation was discovered on October 10, 2017; where at least two (2) Nissan (m/n CP050RENUAE086, s/n N513120 on one and the other m/n and s/n not legible) forklifts needed repairs of seat belts; horn and backup alarm;       c)    This violation was discovered on October 10, 2017; where at least one (1) Yale (m/n and s/n not legible) forklift needed repairs of seat belt; horn and backup alarm;       d)    This violation was discovered on October 10, 2017; where at least one (1) Chicken Hawk (m/n and s/n not legible) forklift needed repairs of seat belt; horn and backup alarm.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.                 Following the work-related hospitalization of an employee that occurred on 09/12/2017, at a jobsite located at 4813 East Hwy.67, Mount Pleasant, Texas, the employer did not make an oral report to OSHA within 24 hours after the occurrence.
