29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: On or about October 5, 2017, the employer failed to ensure that employees working in the foundry were wearing adequate PPE to prevent burns. A worker performing a mold-prep was burned when excess gas ignited and blew-back onto the employee. The employee working in the foundry was not wearing fire-retardant clothing.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): On or about October 12, 2017, the employer failed to adequately assess the workplace to determine the hazards present and neccessary personal protective equipment needed. The employer failed to ensure that employees working in the foundry were wearing adequate PPE to prevent burns. Employees working in the foundry routinely do not wear fire retardant clothing.
