29 CFR 1926.1408(d)(1): Part(s) of equipment, load line, or load (including rigging and lifting accessories) were allowed below an energized power line when the exceptions to paragraph (d)(2) did not apply:    On or about 10/12/17 at 702B Eraste Landry Road, Lafayette, LA, the employer positioned a National truck crane under and in direct physical contact with an energized overhead power line (13.8 kv phase to phase and 7960 phase to ground),while the crane was being used to swing and lift roofing material from the employer's truck to be placed on the roof thus the employee received an electrical shock and was hospitalized.

29 CFR 1926.1408(g)(1): The employer did not train each operator and crew member assigned to work with equipment on topics of this section;  On or about 10/12/17 at 702B Eraste Landry Road, Lafayette, LA, the employer failed to train his employee in the hazards associated with standing next to a truck crane while it approached or rested near a potentially energized zone, the need for crew in the area to avoid approaching or touching the equipment and the load, and the safe clearance distance from power lines; thus the employee received an electrical shock and was hospitalized.

29 CFR 1904.39(a)(2): The employer did not report the in-patient hospitalization of one or more employees to OSHA within twenty-four (24) hours.    On or about 10/12/17 at 702B Eraste Landry Road, Lafayette, LA, the employer failed to report the in-patient hospitalization of one of his employees to OSHA within twenty-four (24) hours after that employee was injured six days earlier while standing next to a National truck crane when the boom of the crane touched an energized overhead power line (13.8 kv phase to phase and 7960 phase to ground); thus the employee received an electrical shock and was hospitalized.
