OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:   Warehouse: Employer is exposing employees to hazardous conditions.  The employees are permitted to work from platforms such as, but not limited to, pallets lifted by fork lifts up to 10 feet from workplace floor without using fall protection systems such as but not necessarily limited to personal fall arrest systems.     On and about 10/16/2017 operators of forklifts stood on pallets elevated by forklifts to store products on shelves and to retrieve products already stored on shelves.  The employees did not use any forms of fall protection systems.

29 CFR 1910.22(d)(1): The employer did not ensure that walking-working surfaces were inspected, regularly and as necessary, and maintained in a safe condition:   Warehouse: Employer is exposing employees to hazardous conditions.  The employees are permitted to use pallets with holes as working platforms  lifted on the forks of powered industrial trucks exposing the employees to tripping hazards where the pallets are not maintained in safe condition.       On and about 10/16/2017 employees were exposed to tripping hazards where holes in the pallets used by the employees as working platforms lifted by powered industrial trucks measured approximately 4 1/2 inches.

29 CFR 1910.178(l) (1) (i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   Warehouse: Employer is exposing employees to hazardous conditions.  The employees are permitted to operate powered industrial equipment without having undergone required formal training and evaluation.   On and about 10/16/2017 employees who had not been trained and certified operated powered industrial trucks such as, but not limited to, Raymond forklifts and Turret order picker exposing employees to struck-by hazards.

29 CFR 1910.37(b)(4): Signs were not posted along the exit access indicating the direction of travel to the nearest exit and exit discharge when the direction of travel to the exit or exit discharge was not immediately apparent:     Warehouse: Employer is exposing employees to hazardous conditions.  The employees are permitted to work in areas where nearest exits are not easily apparent.   On and about 10/16/2017 exit directional signs were not posted where when going from the administrative section into the warehouse directions to the nearest exits were not apparent.
