29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design:  OR  IN THE ALTERNATIVE:  Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:  a)  On or about October 11, 2017 for an employee exposed to fall hazards while working on an elevated work platform, up to 9 feet high, attached to the forks of a GEHL 533 Telehandler where the platform exceed more than two times the load center distance of the forks at or near 3336 Prairie Highway East in West Fargo, North Dakota.  Abatement Note: Among other means, feasible and acceptable methods to correct the hazard would be to follow ANSI B56.6b  1992 Safety Standard for Rough Terrain Forklift Trucks including but not limited to: 1. Use a platform that does not extend more than two times the load center distance listed on the rough terrain forklift truck nameplate, measured parallel to the longitudinal center plane of the truck. 2. Use an alternative means to elevate employees to working levels.
